These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Elaina K. (“Company,” “we,” “us,” or “our”).

By accessing this website, booking services, or completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms prior to payment.

1. SERVICES

The Company provides spiritual, educational, and personal development services, including but not limited to:

• Intuitive Readings

• Reiki Sessions (in-person and distance)

• Spiritual Coaching

• Circle of Sacred Wisdom Spirit Circles

• Elevate Membership

• Digital content, workshops, and related materials

All services are provided for informational, educational, and spiritual development purposes only.

2. SPIRITUAL SERVICES DISCLAIMER

All services are spiritual and educational in nature and are intended for personal insight, reflection, and development.

These services are not medical, psychological, psychiatric, legal, or financial advice, diagnosis, or treatment, and should not be relied upon as a substitute for professional care.

No Guarantees

The Company makes no representations or warranties regarding outcomes of any kind, including but not limited to emotional, physical, relational, financial, or spiritual results.

All interpretations, insights, and guidance are subjective. The Client accepts full responsibility for all decisions, actions, and outcomes resulting from participation in any service.

No Emergency Use

Services are not intended for emergency use. If you are experiencing a medical or mental health emergency, you must contact emergency services or a licensed healthcare provider immediately.

3. GENERAL REFUND POLICY

Unless otherwise explicitly stated:

• All digital products, memberships, and Spirit Circles are non-refundable

• No refunds are issued for late arrival, no-shows, unused time, or lack of participation

• 1:1 services are governed by their specific cancellation terms

• If the Company cancels a service, a refund or reschedule may be offered at its discretion

4. INTUITIVE READINGS

Appointments must be booked and paid in full at time of scheduling.

Cancellation Policy

Cancellations or rescheduling require at least forty-eight (48) hours’ notice via email:

Cancellations made within 48 hours are non-refundable.

Late Arrival

Sessions begin at the scheduled time. Late arrival results in reduced session time equal to remaining time in the appointment window.

No-Shows

No-shows are non-refundable and ineligible for rescheduling.

​

5. REIKI SESSIONS

Reiki sessions follow the same 48-hour cancellation policy as Intuitive Readings.

Cancellations within 48 hours are non-refundable.

6. SPIRITUAL COACHING

 

Cancellation

A minimum of 48 hours’ notice is required for rescheduling.

​

Refunds

No refunds are provided once a session has been delivered or missed.

​

All coaching services are delivered as scheduled and are considered fully earned upon completion.

7. ELEVATE MEMBERSHIP

The Elevate Membership is a subscription-based digital and spiritual education program.

Billing Options

• Monthly recurring subscription

• Annual one-time payment for 12-month access

​

By enrolling, you authorize recurring or one-time charges depending on your selected plan.

​

Monthly Membership

• May be canceled at any time via the member portal

• Access continues through the end of the billing cycle

• No refunds for partial periods or prior charges

​

Annual Membership

• One-time payment for twelve (12) months of access

• All sales are final

• No refunds, prorated refunds, or cancellations after purchase

• Early termination does not result in credit or refund

​

Account Access

Membership credentials are personal, non-transferable, and may not be shared. Unauthorized sharing may result in immediate termination without refund.

Content Access

Content may be updated, modified, or removed at any time at the Company’s discretion.

​

Member Conduct

The Company reserves the right to remove any participant for disruptive, abusive, or inappropriate behavior without refund.

8. SPIRIT CIRCLES

In-person group spiritual experiences held at Elaina K.’s office (110 East D Street, Benicia, CA) or private residence. Location is provided upon booking.

Payment

Full payment is required at time of booking.

​

Refunds

All Spirit Circles are strictly non-refundable.

​

Attendance

Doors close at the start time. Late entry may not be permitted. No refunds or credits are issued for missed or partial attendance.

​

Recording & Media

By attending, you consent to photography and/or video recording for marketing purposes unless you submit a written opt-out request prior to the event.

​

Recording, copying, or distribution of Circle content is strictly prohibited.

​

Removal

The Company reserves the right to remove any participant for disruptive behavior without refund.

​

9. COMMUNICATION POLICY

Email is the primary method of communication for scheduling and administrative matters.

• Response time: 24–48 business hours

• Communication is limited to logistics only

• No expectation of immediate, emergency, or continuous availability is created

10. INTELLECTUAL PROPERTY

All content, materials, recordings, meditations, teachings, and resources are the exclusive intellectual property of Elaina K.

​

No material may be copied, recorded, reproduced, distributed, or shared without prior written consent.

​

​

11. CHARGEBACK & DISPUTE RESOLUTION

By purchasing from Elaina K., you agree to contact us directly first if you have any concerns about a charge or service before initiating a chargeback or payment dispute with your bank or credit card provider.

If a chargeback or dispute is filed without first attempting to resolve the issue with us, we reserve the right to provide all relevant documentation to the payment processor to confirm service delivery. This may include booking confirmations, communication records, and proof of access or attendance.

Services, digital content, and memberships are considered delivered at the time of purchase, scheduled session, or access being granted.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in any service.

​

Total liability, if any, shall not exceed the amount paid for the specific service giving rise to the claim.

 

 

13. TERMINATION

The Company reserves the right to refuse service or terminate access to any offering at its sole discretion for violation of these Terms.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

​

​

15. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

​

16. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

Venue for any disputes shall be Solano County, California.
